Termini e condizioni -  Il Software CARAVAGGIOsoft viene qui denominato Software. 1. UTILIZZO DEL SOFTWARE  Il Software è concesso in uso personale e individuale agli utenti registrati. In caso il software sia utilizzato all’interno di attività di collaborazione – siano esse con Enti pubblici o privati –  si richiede siano trasferiti al soggetto committente, oltre agli eventuali risultati elaborati - quali i valori dei descrittori, il file database e i file di output generati dal software.Salvo autorizzazione scritta degli Autori, non è consentito utilizzare il Software per attività di formazione, all’interno di corsi e a fini dimostrativi. È fatto esplicito divieto di trasferire il software a terzi. In particolare, gli Utenti registrati non sono autorizzati a distribuire il software sia all'interno sia all'esterno del proprio Ente/Società di appartenenza. Tali soggetti potranno ottenere il software mediante registrazione e download diretto. 2. DIRITTI PROPRIETARI  L'Utente prende atto che (a) il Software contiene informazioni proprietarie e riservate, protette dalle leggi sulla proprietà intellettuale applicabili e da altre leggi e (b) qualunque diritto, titolo e interesse in relazione al Software e fornito tramite o insieme ad esso, compresi, tra l'altro, tutti i Diritti di proprietà intellettuale insiti e inerenti, sono di proprietà degli Autori. Per "Diritti di proprietà intellettuale" si intendono tutti i diritti sanciti dalle leggi sui brevetti, sul copyright, sul segreto commerciale, sui marchi e sulla concorrenza sleale, così come ogni altro diritto proprietario e qualsivoglia applicazione, rinnovo, estensione e reintroduzione degli stessi, in vigore attualmente o in futuro in tutto il mondo. L'Utente si impegna a non eseguire per conto proprio e a non consentire a terzi di eseguire quanto segue: copiare, vendere, concedere in licenza, distribuire, trasferire, modificare, adattare, tradurre, preparare materiale correlato, decompilare, decodificare, disassemblare o comunque tentare di estrarre il codice sorgente dal Software senza previa autorizzazione scritta degli Autori. 3. AGGIORNAMENTI  Successivamente al download e all’installazione del CARAVAGGIOsoft potranno rendersi disponibili aggiornamenti del Software e dei parametri numerici (e.g. i punteggi relativi al calcolo dei descrittori e i valori utilizzati per la loro normalizzazione) utilizzati dal Software stesso. Sarà compito dell’utente verificare la disponibilità di nuove versioni del Software e di dati a supporto e non verrà effettuato alcun aggiornamento automatico del Software. 4. CONFORMITÀ ALLA LEGGE  L'Utente si impegna a conformarsi a tutte le leggi e le normative vigenti in materia di download, installazione e/o utilizzo del Software. 5. RISOLUZIONE  È possibile recedere dai presenti Termini e condizioni in qualsiasi momento eliminando il Software in modo definitivo e completo. I diritti dell'Utente decadono automaticamente e con effetto immediato senza preavviso in caso di mancata ottemperanza a quanto disposto nei presenti Termini e condizioni. In questo caso, l'Utente è tenuto a eliminare immediatamente il Software. 6. RISARCIMENTO  L'Utente si impegna a manlevare e risarcire gli Autori, CNR-IRSA, CNR-ITC e i relativi funzionari e dipendenti per ogni e qualsivoglia rivendicazione o azione giudiziaria derivante o connessa all'utilizzo del Software o alla violazione dei presenti Termini e condizioni, ivi comprese eventuali responsabilità o spese derivanti da rivendicazioni, perdite, danni, azioni legali, sentenze, spese processuali e legali di qualsiasi genere e natura. 7. ESCLUSIONE DI GARANZIA  L'utente prende espressamente atto di quanto segue: a) l'utilizzo del software è a proprio esclusivo rischio. Il software viene fornito "così com'è" senza garanzia di alcun tipo. Nella misura massima consentita dalla legge, viene qui esclusa espressamente ogni garanzia e condizione, esplicita o implicita, ivi comprese le garanzie e le condizioni implicite di commerciabilità, idoneità per uno scopo particolare e non violazione di diritti altrui. b) Gli autori non garantiscono in alcun modo (i) che il software soddisferà i requisiti dell'utente, (ii) che il software sia esente da errori o difetti, (iii) la sicurezza, l'affidabilità, la tempestività o le prestazioni del software e (iv) che eventuali errori nel software verranno corretti. c) Tutti i risultati ottenuti tramite l'utilizzo del software (singole caratteristiche, valori dei descrittori etc.) vengono utilizzati a discrezione e a rischio dell'Utente, il quale sarà l'unico responsabile per un eventuale erroneo o non conforme utilizzo di tali risultati. d) l'Utente sarà l'unico responsabile qualora l'utilizzo del software dovesse arrecare danni al computer o ad altri dispositivi. e) Nessuna informazione o consulenza, sia essa orale o scritta, fornita dagli Autori, da CNR-IRSA, da CNR-ITC o da altre terze parti, o ottenuta tramite il software o dal sito web, darà luogo a garanzie non espressamente indicate nei presenti termini e condizioni. 8. LIMITAZIONE DI RESPONSABILITÀ  L'Utente riconosce e accetta espressamente la propria unica responsabilità in merito all’uso del Software per danni diretti, indiretti, incidentali, speciali, conseguenziali o esemplari, compresi, tra l'altro, i danni derivanti da erronea interpretazione dei risultati, uso improprio delle informazioni fornite dal Software, impossibilità di utilizzo, perdita di dati o altre perdite intangibili (anche nel caso in cui gli Autori, CNR-IRSA o CNR-ITC siano stati informati del possibile verificarsi di tali danni) derivanti da: (i) utilizzo o mancato utilizzo del software; (ii) impossibilità di utilizzare il software per accedere a contenuti o dati; (iii) costo di approvvigionamento per servizi sostitutivi; (iv) qualunque altra circostanza inerente il software. 9. DISPOSIZIONI VARIE  a) Legge applicabile e foro competente. I presenti Termini e condizioni saranno disciplinati in base alle leggi Italiane, senza riguardo alle disposizioni sui conflitti di leggi. Il presente accordo e le obbligazioni da esso derivanti sono interamente soggette alla legge Italiana anche se eseguite in tutto o in parte all’estero. Per qualsiasi controversia inerente alla interpretazione o esecuzione del presente contratto è competente il Foro di Roma. b) ID Utente e informazioni personali identificabili. Come parte dell'installazione o dell'utilizzo del Software, all'Utente è richiesto di registrare un ID utente e fornire alcune informazioni personali identificabili a CNR-IRSA. Scegliendo di effettuare la registrazione e fornendo tali informazioni personali identificabili, l'Utente accetta che (a) CNR-IRSA colleghi l'ID Utente alle informazioni personali identificabili per fornire all'Utente, ove ritenuto utile, segnalazioni, pubblicazioni e aggiornamenti software in relazione al metodo CARAVAGGIO e sistemi collegati e che (b) CNR-IRSA fornisca all'Utente importanti informazioni relative ai medesimi argomenti.ENGTerms and Conditions. CARAVAGGIOsoft is referred to hereinafter as the "Software". 1.USE OF THE SOFTWARE. The Software is licensed for personal and individual use to public bodies employees in the execution of their duty and to private employees (private institutions, companies, professionals etc.) for collaborative activities with public bodies or private companies. All users are compulsorily asked to provide their customer with database and output files used and produced by the software. Also, without prior written consent from the authors, the software cannot be used for training activities, within courses and for demonstration purposes. You may not rent, lease, distribute or lend the Software to third parties. In particular, registered users cannot distribute the software within or outside their Institution/Company. [Interested users can obtain the software by download, after registration. Users may be asked to provide a CV demonstrating their experience on MacrOper system or to take part in training sessions dedicated to such system. Details for both procedures will be available at the INHABIT project website  http://www.life-inhabit.it/cnr-irsa-activities/en.].   2. OWNERSHIP. The User acknowledges that (a) the Software contains proprietary and confidential information, protected by applicable intellectual property - and other - laws and (b) all rights, titles and interest in and to the Software and the files associated therewith, including all intellectual property rights, are owned by the Authors. By Intellectual property rights are intended all the rights enshrined in the laws on patents, copyright, trade secret, trademark and unfair competition, and any other proprietary rights, applications, renewals, extensions and restorations thereof, now or hereafter in force around the world. The User may not: make any copies of the Software, sell, rent or lease the Software, make available to download the Software to the public, transfer the Software to any third person or parties by wire or any other means. Also, the User may not modify, adapt, translate, reverse engineer, disassemble, decompile the Software, use the Software to create any derivative software and try to decrypt the Software source code without prior written consent from the authors. 3. UPDATES. After the download and installation of the Software, updated versions of the Software itself or of the numerical values used by the Software (e.g. scores for descriptors calculation or normalization values) may become available. It will be up to the user to check the availability of the software new versions and/or support data. No automatic update of the Software will be provided. 4. COMPLIANCE WITH LAWS. The User agrees to comply with all applicable laws and regulations regarding download, installation and/or use of the Software.  5. TERMINATION. The User may terminate these Terms and Conditions at any time by entirely and definitely deleting the Software. The User’s rights automatically and immediately terminate without notice if the User fails to comply with any provision in these Terms and Conditions. In this case, the User is obliged to immediately delete the Software.  6. INDEMNIFICATION. You agree to and relieve and indemnify the Authors, CNR-IRSA, CNR-ITC and their officers and employees from and against any claim or cause of action arising out of or related to your use of the Software or your violation of these Terms and conditions, including any liability or expense arising from all claims, losses, damages, suits, judgments, litigation and legal costs of any kind and nature.  7. DISCLAIMER: WARRANTY. You expressly acknowledge that: a) the use of the software is at your own risk. The software is provided on an "as is" basis without any warranty of any kind. To the maximum extent permitted by law, all warranties and conditions, express or implied, are hereby expressly excluded, including the warranties and conditions of merchantability, fitness for any particular purpose and non-infringement. b) The Authors do not guarantee in any way (i) that the software will meet users requirements, (ii) that the software is free from errors or defects, (iii) the safety , reliability, timeliness or performance of the software, and (iv) that any errors in the software will be corrected. c) All the results obtained through the use of the software (single characteristics, descriptor values etc.) are used at the discretion and risk of the User, who shall be solely responsible for any erroneous or non-compliant use of such results. d) the User will be solely responsible if the use of the software should cause damage to computers or other devices. e) No advice or information, whether oral or written, provided by the Authors, CNR-IRSA, CNR-ITC or other third parties, or obtained through the software or website, will result in guarantees not expressly set out in these terms and conditions. 8. DISCLAIMER: RESPONSIBILITY. You understand and expressly agree that it is your sole responsibility to use the Software for any direct, indirect, incidental, special, consequential or exemplary damages, including, among others, damages resulting from misinterpretation of the results, misuse of information provided by the Software, inability to use the Software, loss of data or other intangible losses (even if the Authors, CNR-IRSA or CNR-ITC have been informed about the possibility of such damages) resulting from: (i) use or non-use of the Software; (ii) inability to use the Software to access content or information; (iii) the cost of substitute services; (iv) any other circumstances inherent or related to the software. 9. GENERAL. a) Governing Law and Jurisdiction. The laws of Italy govern these Terms and Conditions, without regard to its conflict of law provisions. By downloading and using the Software you consent to these terms and conditions and to the exclusive jurisdiction of the Italian courts in all disputes arising out of such access. This Agreement and the obligations arising from it are entirely subject to Italian law even if performed wholly or partly abroad. Any dispute concerning the interpretation or the execution of this contract, are within the jurisdiction of the court of Rome. (b) User ID and personal information. As part of the installation or use of the Software, the User is required to register a user ID and provide some personal information to CNR-IRSA. By choosing to register and provide such personal information, you agree that (a) CNR-IRSA connects User ID to any personal information in order to provide the User, if deemed useful, reports, publications, and software updates related to MacrOper system and connected systems (b) CNR-IRSA provides the User important information related to the same topics.
